The Legislative Program provides important information about RPEA’s
current legislative work. The 2008 Legislative Program is designed
around four areas to Preserve, Support, Promote, and Protect. As
specific legislation is developed we will be able to provide our members with
information on key bills, memos written in support or opposition to key
bills, and scorecards showing where state lawmakers stand on major
pieces of legislation.
The Community Lobby Committee — under the direction of co-chairs Fred
Ames and Dick Rice — will be leading the advocacy and steering the 2008
Legislative Program. This year, Anthony Cantore has joined the staff as
our Legislative Representative. He has developed a new look and feel for our program materials. “We are quite optimistic about this approach and the show of
support from members,” Michael Fitzgerald, RPEA Executive Director said.

2008 RPEA LEGISLATIVE PROGRAM

I. Preserve Retiree Health Insurance Benefits
Health insurance benefits for all educational, state and local government retirees should be permanently protected as health insurance for educational retirees has been protected and extended on an annual basis since the enactment of Chapter 729 of the Laws of 1994.
- Task Force Establishment & Health Insurance Moratorium - Support the establishment of a twelve member Task Force on Retiree Health Insurance Protection to study and recommend cost-effective strategies for protecting adequate and affordable health insurance for retired educational and public employees and their dependents. Pending the Task Force’s report, health insurance benefits shall not be diminished for such employees and their dependents below the level of benefits provided to corresponding active employees until June 30, 2009.

II. Support Income Security for Retirees
Inflation erodes retirees’ standard of living, especially for lower income and older retirees. Increases in pension benefits have lagged far behind the Consumer Price Index (CPI). Improved Cost of Living Adjustments (COLAs) should be enacted to enable retirees to combat inflation.
- CPI “Catch-Up” - Advance COLA tables by 5 years for retirees between 1961 and 1972.

- CPI Increase - Increase future COLAs from the present limit of 50% of the CPI to the full CPI.

- COLA Pension Base - Raise COLA pension base from $18,000 to $25,000.

III. Promote Pension Equity for Certain Public Employees
- Retiree Tier Reinstatement:
Seek passage of legislation to extend the provisions of Chapter 640 of the Laws of 1998 to include the remaining retirees who lost their pension tier membership due to pregnancy or family care giving responsibilities. End discrimination for 3,000 retired teachers and retired public employees who not only experienced gender discrimination, but also experienced age discrimination because they had retired prior to Chapter 640’s effective date.

- Veterans’ Service Credit:
Seek passage of legislation to allow all retirees who are veterans who served in combat theaters or during periods of wartime to apply for and receive up to 3 years of military service credit as a supplemental allowance to their pensions.

IV. Protect Families of Deceased Retirees
- Unremarried Spouse Health Insurance Benefits: - Seek equity in health insurance coverage for certain unremarried spouses of deceased retired public employees.

- Survivor’s Death Benefit - Increase Survivor’s death benefit by $500.
